1. Introduction
These Terms of Use (“Terms”) form a legally binding agreement between you (“User”, “you”) and StayPicker (“Platform”, “we”, “us”, “our”). By using the StayPicker platform at staypicker.com or any related services, you agree to these Terms in full.
StayPicker is an online booking platform that enables property owners and service providers (“Hosts”) to publish accommodations or experience listings (“Listings”), and allows guests (“Guests”) to browse and book them. StayPicker does not own, manage, or provide the properties or services listed on the platform. All bookings represent a direct agreement between Host and Guest.
2. Nature of the Platform
2.1 StayPicker provides digital tools for publishing, promoting, searching, and booking accommodation and related services.
2.2 StayPicker is not a contracting party in agreements between Hosts and Guests.
2.3 We do not verify or guarantee the legality, condition, safety, accuracy, or availability of Listings.
2.4 All responsibilities arising from a stay, service, or experience lie directly between the Host and the Guest.
3. Eligibility
By using StayPicker, you confirm that:

• you have the legal capacity to enter into binding agreements,
• you will comply with applicable laws and regulations,
• you will not misuse the platform or Listings.

4. Responsibilities of Hosts
4.1 Hosts are fully responsible for the content of their Listings, including availability, descriptions, rules, pricing, additional fees, and any required local permits or registrations.
4.2 Hosts guarantee that the accommodation or service complies with all legal, safety, and regulatory standards.
4.3 Hosts are responsible for delivering the accommodation/service as described.
4.4 Hosts must comply with tax obligations, including tourism tax, VAT, or income reporting required by local law.
4.5 Hosts may not circumvent the StayPicker platform by directing Guests to book outside the system to avoid fees or tracking.
5. Responsibilities of Guests
5.1 By making a booking, the Guest enters into a binding agreement with the Host.
5.2 Guests must review all Listing details, including rules, cancellation policy, and additional charges, prior to booking.
5.3 Guests must respect the Host’s property, rules, check-in/out times, occupancy limits, and all applicable laws.
5.4 Guests are responsible for any damages or misconduct during their stay and may be required to compensate the Host.
6. Pricing, Fees & Payments
6.1 Prices displayed on StayPicker include accommodation/service fees and may include additional charges or taxes if the Host specifies them.
6.2 Hosts independently determine the pricing of their Listings.
6.3 Guests agree to pay the full amount shown during the booking process.
6.4 Hosts are fully responsible for collecting and reporting applicable taxes and charges.
7. Cancellations & Modifications
7.1 Each Listing contains a cancellation policy defined by the Host. Guests must review these terms before booking.
7.2 Refunds follow the Host’s cancellation policy at the moment of booking confirmation.
7.3 Hosts who cancel confirmed bookings without valid justification may be penalized by reduced listing visibility or removal.
7.4 Booking changes require approval from the Host and may result in additional charges.
8. User Conduct
Users agree not to:

• post misleading, false, or fraudulent information;
• violate laws, rules, or safety standards;
• harass, discriminate, or threaten other users;
• post content that is offensive, unlawful, or harmful;
• interfere with platform functionality or security.

We may suspend or restrict access to StayPicker for violations of these Terms.
9. Reviews & User-Generated Content
9.1 Guests may leave reviews after completing a stay or experience.
9.2 Reviews must be honest, respectful, and based on real experiences.
9.3 We may moderate, hide, or remove content that violates these Terms.
9.4 By submitting content to StayPicker, you grant us the right to display and use that content for platform-related purposes.
10. Platform Availability & Suspension
10.1 We may update, limit, suspend, or modify the Platform at any time for maintenance or security reasons.
10.2 Users may stop using the platform at any time, but existing bookings and obligations remain valid.
11. Disclaimer of Warranties
11.1 StayPicker is provided “as is” and “as available.”
11.2 We do not guarantee uninterrupted access, error-free operation, or the accuracy of Listings.
11.3 StayPicker does not endorse, control, or guarantee the performance or behavior of Hosts or Guests.
12. Limitation of Liability
To the fullest extent permitted by law, StayPicker is not liable for:

• property damage, injury, incidents, theft, or losses arising during a stay or service,
• disputes between Hosts and Guests,
• damages from using or being unable to use the platform,
• inaccuracies or errors in Listings.

Hosts and Guests use the platform at their own risk.
13. Indemnification
Users agree to indemnify and hold harmless StayPicker, its operators, affiliates, and partners from claims, damages, liabilities, and expenses arising from:

• violations of these Terms,
• disputes between Hosts and Guests,
• misuse of the Platform,
• illegal or harmful conduct.

14. Updates to Terms
14.1 StayPicker may update these Terms at any time.
14.2 Updated Terms become effective upon publication.
14.3 Continued use of the Platform means you agree to the updated Terms.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the jurisdiction in which StayPicker is operated and registered.
Disputes arising from these Terms shall be handled by the competent courts of that jurisdiction, unless mandatory consumer laws state otherwise.
